Your QueueMovies that you select to rent will be placed into your own rental queue. You may add movies or adjust the queue at any time. You must have at least 10 movies in your queue. Click the "Queue" tab to make adjustments, review requested movies or to see which movies you currently have out. We will determine which movies to send you based on the movies in your queue and the priority in which you have listed them. We endeavour to ship to you the movies listed highest in your queue; however when availability is limited, we may ship you movies lower on your queue. Adjustments made to your queue may not immediately impact your next shipment. In certain instances you may have adjusted your queue before you have received a shipment message when in fact a shipment was already processed. The adjustments will, however, impact subsequent shipments.
Allocation, Delivery and Return of Rented DVD/VCDsWe reserve the right to allocate and ship DVDs/ VCDs among our subscribers in any manner that we, in our sole and absolute discretion, determine. In addition, we will, in our sole and absolute discretion, determine the quantity of DVDs/ VCDs we purchase for any particular title and the level of staffing and number of shipments to be processed at each distribution centre. As a result, we may not always send you the top choices from your queue, and we may not ship out your next DVDs/ VCDs on the same day that we receive one from you. At present, our goal is to ship you the DVDs/ VCDs listed highest in your queue. Also, we currently try to ship you DVDs/ VCDs from the distribution centre closest to you so that you get movies quickly. Often, on the same day that we receive a DVD/ VCD from you, we will ship the next available DVD/ VCD from your queue. In certain instances, your next available DVD/ VCD will not ship until at least one business day following our receipt of your returned movie.
Other factors that may affect delivery times, include, but are not limited to, (i) the distance between the distribution centre from which your DVD/ VCD was shipped and your delivery address, (ii) the timing of your placement or adjustment of movies in your queue.
We ship movies 8 am to 10 pm, 7 days a week, Monday through Sunday (except public holidays). We make no guarantee as to the shipping and delivery of DVDs/ VCDs and may in our sole and absolute discretion, change our business practice regarding allocation, delivery and shipping, without notice. We may from time to time revise these Terms of Use but we will not necessarily provide you notice of the revisions. It is up to you to review the Terms of Use frequently to determine if there have been changes.
We will send you an email letting you know when we have received a returned movie, and we will also send you another email letting you know when we have shipped your next DVD/ VCD, including the anticipated time of delivery.
Seventymm™ reserves the right to request return of any and all DVDs and/or VCDs in the possession of Members at any time. Members understand and agree to promptly return any DVDs and/or VCDs to Seventymm™ upon request, and that failure to do so within five (5) days of the request makes Members liable for the cost of those DVDs and or VCDs plus 50% of that cost as a handling charge, for which Seventymm™ reserves the right to charge the Member's refundable security deposit.
BillingBy using the Seventymm™ service, you are expressly agreeing that we are permitted to bill you a monthly subscription fee, any applicable tax and any other charges you may incur in connection with your use of the Seventymm™ service. Additional charges may include movies you fail to return, or a billing plan change you request. As used in these Terms of Use, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method, including a checking account, where applicable. The subscription fee will be billed at the beginning of your subscription and on each monthly renewal thereafter unless and until you cancel your membership. Click the "View Membership Terms" link on the "Your Account" page to see the commencement date for your next renewal period. We will automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your membership. In the event your membership began on a day not contained in a given month, we will bill your Payment Method on the last day of such month. For example, if you became a paying member on January 31st, your Payment Method would next be billed on February 28th. All fees and charges are non-refundable and there are no refunds or credits for partially used periods. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email. If you want to use a different Payment Method or if there is a change in your credit card validity or expiration date, you may edit your Payment Method information by clicking on the "Your Account" button, available at the top of the pages of the Seventymm™ Website. If your Payment Method reaches its expiration date, your continued use of the service constitutes your authorisation for us to continue billing that Payment Method and you remain responsible for any uncollected amounts.In case the bills are not paid as on the due date, your account will be suspended and you will not receive any further movies, till such time the payment is made and your account is regularized. In case of your account suspension, you will have to return the movies lying with you within 7 days.
ChequebounceIn the event of Chequebounce of your membership payment, you will be liable to pay the chequebounce fee to Seventymm™ Services Private Limited.
Automatic RenewalsYour Seventymm™ subscription will be automatically renewed on a monthly basis. We will bill the monthly subscription fee plus any applicable tax to the Payment Method you provide to us during registration (or to a different Payment Method if you change your account information). Your membership will automatically renew for successive monthly subscriptions, without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews each month in order to avoid billing of the next month's subscription fees to your Payment Method.
Damaged DiscsAll discs sent to you have been checked to be in a working condition prior to dispatch. Upon receipt of the discs, you must ensure that the same is playable on your respective player. Any anomaly, if found, must be reported to our courier executive. Failure to check and/or report the same will be constituted as your having received a playable disc. At the time of pick-up, our courier executive will check for any scratches or damage to the disc and will intimate you accordingly. Upon receipt of the disc, we will verify the same.
In the event of a disc being damaged, we will email you and intimate you about the same. The determination of a disc being “damaged” will be at the sole discretion of Seventymm™. Accordingly, we will charge you Rs 300 per VCD title (which includes even 1 damaged disc from a set of 2 or 3 discs) and Rs 1000 per DVD title. All such damage charges will be chargeable against your refundable security deposit. A top-up of the refundable security deposit will be required by the due date of the next billing cycle failing which your membership will be suspended.
Refund of Security DepositIn the event that your membership is cancelled, we will refund your security deposit after ensuring all outstanding charges applicable have been recovered.. We issue a bank cheque in the name of the member as appears at the time of registration within fifteen working days. The cheque will be couriered to the billing address as provided at the time of registration or as last appended prior to the commencement of your last billing cycle.Once movies are delivered, if they are not returned within a period of 45 days, the deposit would be forfeited.
CancellationYou may cancel your subscription to Seventymm™ at any time, and cancellation will be effective immediately. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH SUBSCRIPTION PERIODS OR UNWATCHED MOVIES. To cancel, click the word "Cancel" on the "Your Account" page and follow the instructions for cancellation under the heading "Cancel Membership". Upon cancellation, you will be given seven (7) days to return any outstanding rentals. Failure to return such rentals will result in your Payment Method being billed for such items.
Seventymm™ reserves the right to suspend / cancel your membership without prior notice and without assigning any reasons.
What if I want to upgrade for some months during the period?Upgrading from basic to unlimited is very simple. All you have to do is calculate the fee at printed rate and pay the balance. For e.g. if you’re on the 6-month package for the Basic Plan and want to shift to the Unlimited Plan in the middle of 3 months, you have to just pay the difference amount. Please contact our customer care office for more details on payment.Please note: The credit period for each plan will be applicable at the beginning of the billing month/months after subscribing to the plans.
What if I want to downgrade my plan for some months during the period?You can do so for which the plan will be charged at a pro-rata basis.
What if I want to cancel during the period?Cancellation is possible at any time. However, we will not be able to refund the money paid for the package. What you do get back is the refundable security deposit and balance earned through referrals (only if applicable). The balance amount doesn’t include the membership fees paid in advance.
If I am an existing member, can I upgrade to the package deal?Yes you can. All you have to do is pay the 6-month package or the 12-package fees you want to subscribe to. Since you have paid the registration fee and security deposit earlier, you don’t have to pay anything for that.
I have been given a promotional offer? Can I also opt of the 6 / 12 month package?Yes you can. However, the package will be applicable only after the promotional period is over. Please contact our customer care office in your city for payment terms and more details.
Payment of Accumulated EarningsSeventymm™ Services Private Limited will issue the member a statement of his or her earnings of the month. This amount will be reduced from the members' dues to Seventymm™ Services Private Limited on the 5th day of a month following a 30-day period after he or she registers with the Website. If the amount due to the member is more than the dues to Seventymm™ Services Private Limited then a cheque for the same amount will be issued to the member on the 5th day of a month.
Tax deduction at source and reporting: Seventymm™ Services Private Limited would deduct the taxes applicable at source while making payment for the earnings through the referral programme . We may also be required by the tax authorities to report your income from Seventymm™ Services Private Limited.
Currency: All monetary amounts referred to herein are in Indian Rupees
Audit: Seventymm™ Services Private Limited reserves the right to audit your membership, including your referrals from time to time to check fraud, breach of this agreement or any illegal activity.
Members may not use spam to obtain referrals. You may not use spam to gather referrals "Spam" includes(a) Unsolicited email, i.e., email sent to people you do not know personally, unless those people have expressly asked to receive email announcing programs of this type.(b) Mass, bulk or "junk" emails of any kind, unless those people have expressly asked to receive email announcing programs of this type.(c)) Use the net, chat room or message board postings that are unrelated to the topic of discussion of the particular news group, chat room or message board.
Seventymm™ Services Private Limited reserves the right, in its sole discretion, to terminate the Membership of any Member.
If Seventymm™ Services Private Limited has reasonable evidence that a particular member has used spam to gain referrals, it has the right to terminate the spammers' membership. In addition the member may be subject to government penalties and other legal consequences under the law applicable. Our anti-spam policy provides more details and is incorporated by reference into this agreement.
Your relationship with Seventymm™ Services Private Limited:Your relationship with the company is that of an independent customer. You are not an employee or agent of Seventymm™ Services Private Limited. Neither you nor other members are authorized to make any statement or representations on behalf of Seventymm™ Services Private Limited, its website or referral program. Seventymm™ Services Private Limited will not be bound by, or be liable for any statement or representation made by you or by any member of the referral program.
Your relationship with other members:You agree not to make any misrepresentations to any members' referrals or potential referrals regarding the Referral Program or Seventymm™ Services Private Limited, including, but not limited to statements with respect to compensation typically received by members of the program or with the compensation that potential members are likely to receive.
Termination of the program: Seventymm™ Service Private Limited may terminate the Referral Program at any time, by posting the termination on the website and sending an email to your email provided while registering for the service. The earnings you have accrued at that time shall be handled in the manner provided below under "Earnings upon Termination". It is your responsibility to inform the company if your e-mail address changes. You will cease to accrue earnings from the Referral Program as of the date of the termination notice.
Termination of membership:Seventymm™ Services Private Limited may terminate your Membership without prior notice of your Material Breach of this agreement. "Material Breach" includes:
(a) Any violation of any of the provisions of this agreement(b) Acting unlawfully in relationship to Seventymm™ Services Private Limited or the website.(c) If there is a breach of our Anti-Spam Policy.(d) For providing incomplete, false, bogus or otherwise incorrect information to us.(e) Creating duplicate or illegal Memberships. If your Membership is terminated due to Material Breach of this agreement, as provided above, your accrued earnings balance will be forfeited, and you will not accrue any further earnings following your termination. If your membership is terminated by Seventymm™ Services Private Limited you may not re-enroll or join the program unless formally invited to do so by Seventymm™ Services Private Limited.
If you cancel your membership as provided above, Seventymm™ Services Private Limited will send you a check equivalent to the referral earnings minus any money you owe to Seventymm™ Services Private Limited and deduction of applicable taxes at source within one hundred and twenty (120) days from the date of cancellation.
Memberships are not transferable:Your membership, password and accrued earnings are personal to you and are not transferable. You may not allow anyone else to use your password, earnings or membership. You may not use anyone else's password or membership or act to accrue earnings for anyone else. You are responsible for keeping your password secret. Seventymm™ Services Private Limited is not liable far any damage caused by any disclosure of your password. You may create a membership only for yourself; you may not establish Membership on behalf of anyone else.
You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You may choose to share your account with other people by providing them your password. However, if you decide to share your account with other people, you take full responsibility for their actions. Users of public or shared computers should log out at the completion of each visit to the Seventymm™ Website.
If you find that you're a victim of identity theft and it involves a Seventymm™ account, you should notify customer service. Then, you should report this instance to all your credit card issuers, as well as your local law enforcement agency. Seventymm™ reserves the right to place any account on hold anytime with or without notification to the subscriber in order to protect itself and its partners from what it believes to be fraudulent activity. Seventymm™ is not obligated to credit or discount a membership for holds placed on the account by either a representative of Seventymm™ or by the automated processes of Seventymm™.
In no event shall Seventymm™ Services Pvt. Ltd., its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Seventymm™ Website, its contents or our service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
The use of DVD/VCDs rented to you by us is solely for your personal and non-commercial use. Please see the instructions at the end of these Terms of Use for notifying us of the presence of any allegedly infringing content on the Seventymm™ Website.
